State bodies and agencies, as well as media outlets, must make the protection of children\u2019s personal data a priority and take adequate measures to avoid the unlawful processing of children\u2019s personal data.<\/p>\n<p>During a March 16 discussion organized by the Armenian Child Protection Network, board chair Arshak Gasparyan remarked that the people in charge of websites are those who process personal data, and so they are obliged to collect the least amount of children\u2019s personal data that is necessary to achieve their intended purpose. Nothing more.<\/p>\n<p>According to Gasparyan, these days, it\u2019s become harder to protect children\u2019s personal data.<\/p>\n<blockquote>\n<p>Anonymizing children<\/p>\n<\/blockquote>\n<p>Head of the Administrative Proceedings Implementation Department of the RA Ministry of Justice\u2019s Personal Data Protection Agency Gevorg Hayrapetyan says that earlier this year, the agency developed and published a relevant <a href=\"http:\/\/moj.am\/storage\/uploads\/001.Ughecuyc-erexaneri_andznakan_tvyalner.pdf\">guide<\/a> [AM], which can be useful also to journalists.&nbsp;<\/p>\n<p>In just one year, the media has committed several gross violations of children\u2019s personal data protection. The agency issued an <a href=\"http:\/\/moj.am\/storage\/uploads\/Save-the-Children-FINAL-1.pdf\">advisory decision<\/a> [AM] regarding one such violation.<\/p>\n<p>Hayrapetyan provided examples of violations of children\u2019s personal data protection in Armenia. There were cases whereby a child\u2019s personal data was openly published then reprinted in the press after all the data of the proceedings of a sexual assault case involving an underage girl were entered in <a href=\"http:\/\/www.datalex.am\/\">DataLex<\/a> [an online judicial information system].&nbsp;<\/p>\n<p>\u201cFully available on the website was the minor\u2019s first and last name, residential address, information that there was a violent episode in her sexual life, and so on. The media outlets had published all that. The media outlet hadn\u2019t broken the law; it simply reproduced open data. We contacted the media outlet, and it anonymized the girl, leaving only her initials. But the European Court of Human Rights (ECtHR) says that when anonymizing, the size of the community has to be taken into account. In some cases, the initials should be entirely removed, since in small communities it\u2019s very easy to understand who is, for instance, the minor F. K.,\u201d says Hayrapetyan.&nbsp;<\/p>\n<p>The ECtHR, for example, when publishing children\u2019s rights cases writes<em> T. v. the United Kingdom <\/em>or <em>S. v. Moldova<\/em> \u2014 in other words, only one identifying letter.<\/p>\n<p>The guide published by the Personal Data Protection Agency clearly stipulates how to process personal data, how to maintain the principle of transparency, and so on. The guide is based on international best practice and the provisions of the RA Law on Personal Data Protection.<\/p>\n<p>\u201cThis can never been viewed as a restriction on journalists\u2019 freedom of expression. This is just a call so that they, in turn, know the importance of children\u2019s personal data and apply it,\u201d says Hayrapetyan.&nbsp;<\/p>\n<p>Children\u2019s personal data can be published in the media when it\u2019s not possible to achieve an intended purpose through anonymization. We\u2019re talking more about social journalism, when journalists are often forced to describe a child in poverty.&nbsp;<\/p>\n<p>\u201cWhen they film a dirty, crying child and say he doesn\u2019t have money and so on, and this is done only for the purpose of getting a new backpack on September 1, well, in this case, the publicizing is clearly disproportionate. Publicizing children in poverty can be done also without interfering in anyone\u2019s private life, anonymizing, covering the face, changing the voice, and so on,\u201d says Hayrapetyan.&nbsp;<\/p>\n<p>Personal data can be considered justified, for example, when by releasing this information, it becomes possible to save a child\u2019s life, make donations for medical treatment, and so on.<\/p>\n<p>Hayrapetyan draws journalists\u2019 attention to the fact that the interest of the person with the authority to grant permission to disseminate a child\u2019s personal data (e.g., a parent) sometimes may not correspond with the child\u2019s interest. Therefore, the journalist must refrain from publishing personal data even in such cases.&nbsp;<\/p>\n<p>Violating the provisions of the Law on Personal Data Protection is punishable by a fine of 50 to 500 thousand AMD (about $100 to $1,000 USD).<\/p>\n<blockquote>\n<p>When \u2018ancestral experience\u2019 is powerless<\/p>\n<\/blockquote>\n<p>Media researcher Samvel Martirosyan says journalists violate the right to children\u2019s personal data protection because they\u2019re uninformed.<\/p>\n<p>\u201cYou can\u2019t google \u2018child victim\u2019 and publish whatever picture that comes up. You\u2019re talking about one child\u2019s story and publishing a different child\u2019s photo.\u201d<\/p>\n<p>According to Martirosyan, the issue of child protection in Armenia begins from the fact that we\u2019re a child-loving nation and we think that a child should have an iPad from a young age. \u201cA tremendous number of children today have smartphones and iPads, and we believe that there are a lot of things online that help with [cognitive] development. The parents believe that if the child doesn\u2019t engage with high tech from the age of three, he\u2019ll fall behind and won\u2019t find a job at age 20 and won\u2019t be accepted into university at 17.<\/p>\n<p>\u201cThis belief is so widespread that it has resulted in very strange reforms in the education system. On one hand, children are taking informatics in seventh grade; on the other hand, first graders are getting tablets. That is to say, a part of the education system doesn\u2019t quite understand what the other part is doing because if we consider that a tablet is a good thing in first grade, then the child should have at least a basic idea what that is.\u201d<\/p>\n<p>There are several dangers, according to Martirosyan. First, children cannot apply their own judgment to the dangers of the internet. If in all other cases children learn through the older generation, through fairytales, fables, reprimands, and so on, then in the online domain \u201cancestral knowledge\u201d doesn\u2019t exist.&nbsp;<\/p>\n<p>\u201cNo one\u2019s grandfather before dying said, \u2018My son, make your passwords longer than 10 characters.\u2019 We\u2019ve entered an area where the older generation is more unprepared than the new generation, which creates the illusion that \u2018my grandchild knows everything, while I don\u2019t understand anything.\u2019 The family gets the impression that the grandchild is a scholar of technology.<\/p>\n<p>\u201cAvailable to children today with one click are things that are a big problem. There are parental controls, through which it\u2019s possible to filter the information the child receives through the computer. But this doesn\u2019t help unequivocally,\u201d says Martirosyan.<\/p>\n<p>Recently, one of the most read Armenian sites at 7 p.m. published a YouTube video depicting Islamists very slowly crushing a Syrian soldier with their tank. And this was shared also on Facebook.<\/p>\n<p>\u201cIf a child sees that, it\u2019s not hard to imagine what he\u2019ll experience. And the parents may not know that their child saw this,\u201d says the media researcher.<\/p>\n<p>Martirosyan says that parents should be informed and taught the rules of digital security. There are programs that filter prohibited sites, though which it\u2019s possible also to limit the time a child spends online.&nbsp;<\/p>\n<p>Martirosyan also advises parents not to buy their children smartphones. Parents, according to him, must understand that an ordinary, small phone is enough for schoolchildren to be connected.
