This gave the impression that the requirement for citizens to be vaccinated or to have a mandatory PCR test every 7 days was removed. Meanwhile, the wording &#8220;the employee carries out at their own expense&#8221; was declared unconstitutional.<\/span><\/p>\n<p><span style=\"font-weight: 400\">&#8220;Recognize the phrase &#8216;at his own expense&#8217; as contradictory and invalid in accordance with Article 6\u00a0 part1 and part 2 and Article 39 of the Constitution, taking into account that when using the PCR diagnostic service to diagnose of coronavirus (COVID-19), the definition of the scope of entities (employees) liable to pay for it is beyond the scope of the powers vested in the Minister of Health by law,&#8221; the CC said in a <\/span><a href=\"https:\/\/www.facebook.com\/armconcourt\/posts\/1350709125385898\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">statement<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It turns out that the ministry does not have the authority to decide &#8220;at whose expense&#8221; the employee will carry out the testing. However, for those who have not been vaccinated, it is still mandatory to submit a test result when going to work.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Channel 5 <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=EK0P38cEL4M&amp;ab_channel=5TVChannel\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">described<\/span><\/a><span style=\"font-weight: 400\"> the decision of the Constitutional Court as a victory of &#8220;Armenia&#8221; bloc MP Aram Vardevanyan over Minister Anahit Avanesyan. And the head of the legal department of the Ministry of Health Anna Mkrtumyan <\/span><a href=\"https:\/\/www.facebook.com\/ministryofhealthcare\/posts\/210607061261172\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">assured<\/span><\/a><span style=\"font-weight: 400\"> that the court decision is the victory of the ministry.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Despite these statements, the decision of the Constitutional Court cannot be called the victory of anyone. It is true that the wording of one of the annexes to the minister&#8217;s order was declared unconstitutional, and it turns out that the ministry made an unconstitutional decision, but the requirement for PCR testing remains a legal and mandatory requirement.<\/span><\/p>\n<p><span style=\"font-weight: 400\">One of Aram Vardevanyan&#8217;s main demands was to <\/span><a href=\"https:\/\/www.azatutyun.am\/a\/31580374.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">force<\/span><\/a><span style=\"font-weight: 400\"> the government to reimburse for PCR tests, while the decision of the Constitutional Court did not impose such a claim on the state or the employer. It is unknown at this time what he will do after leaving the post. The full text of the decision must be published on the official website of the Constitutional Court within three days.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400\">Is the cost of testing a state responsibility?<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400\">Aram Vardevanyan, a member of the &#8220;Hayastan&#8221; faction, who filed a complaint in the High Court, <\/span><a href=\"https:\/\/www.facebook.com\/aramo.vardevanyan\/videos\/514419113443183\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">announced<\/span><\/a><span style=\"font-weight: 400\"> live on Facebook yesterday that the burden of paying for the tests will no longer fall on the citizen&#8217;s shoulders, and the state must bear the cost.<\/span><\/p>\n<p><span style=\"font-weight: 400\">&#8220;People should not be held responsible by the state, people should not bear the burden of coronavirus PCR testing costs. Our position was logical for the simple reason that the state is responsible for this whole process, the state must provide the necessary conditions, therefore, it should not leave the burden of expenses on citizens,&#8221; said Vardevanyan.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, as we have already mentioned, the decision of the Constitutional Court did not specify on whom the burden of compensation would be imposed. This claim is therefore an arbitrary interpretation of the court decision.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Vardevanyan also spoke about international experience, reproducing the previously denied information that &#8220;international experience says that this responsibility should not be at the expense of the person, that is, at the expense of human resources, because in that case, it turns into a process of compulsory vaccination.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Media.am <\/span><a href=\"http:\/\/media.am\/en\/verified\/2021\/10\/12\/29969\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">covered<\/span><\/a><span style=\"font-weight: 400\"> Vardevanyan&#8217;s claims about the international experience back in October.
